Terms of Service

1.Scope and Provider

These Terms of Service govern the use of the web application flnt (hereinafter “Service”), provided by:

The Service is available to both commercial users (e.g. agencies, freelancers) and private individuals.

2.Description of Service

flnt is a web-based application that helps creative strategists systematically develop direct response advertising campaigns. The Service includes in particular:

  • A guided 5-step framework for developing messaging angles
  • AI-assisted suggestions powered by the Anthropic Claude API
  • Project-based management of campaign strategies
  • Export functionality for creative briefs

The Service is provided free of charge. There is no legal entitlement to the permanent availability of the Service.

3.Registration and User Account

3.1 Requirements

Use of the Service requires registration with a valid email address. By registering, you confirm that the information you provide is accurate and complete.

3.2 Account Security

You are responsible for the security of your login credentials and all activities that occur under your account. Please notify us immediately at contact@flnt.work if you suspect unauthorized access to your account.

3.3 Minimum Age

Use of the Service is restricted to persons aged 18 and over.

4.Usage Rights and Licenses

4.1 Right to Use the Service

Upon registration, you receive a simple, non-transferable right to use the Service for your own professional or personal purposes.

4.2 Ownership of Content

All content you create while using the Service (e.g. project data, messaging angles, campaign briefs) remains your property. You grant us only the technically necessary right to store and process this data for the purpose of providing the Service.

4.3 AI-Generated Content

Content generated by the AI features of the Service may be used by you. However, we make no warranty as to the accuracy, completeness, or suitability of AI-generated suggestions. Responsibility for the use of such content lies with you.

4.4 Intellectual Property of the Service

All rights to the application itself, its design, and its code remain with the provider.

5.User Obligations

When using the Service, the following are prohibited:

  • Entering or distributing content that violates applicable law
  • Using the Service for automated bulk queries or scraping
  • Circumventing or manipulating security mechanisms of the Service
  • Using the Service in ways that harm the interests of third parties
  • Entering personal data of third parties without a legal basis
  • Reselling or commercially licensing the Service to third parties

6.Availability and Maintenance

We strive for high availability of the Service but do not guarantee uninterrupted availability. Maintenance work, technical disruptions, or changes by third-party providers (e.g. Anthropic, Supabase, Vercel) may temporarily limit functionality. No claims for damages arising from unavailability shall be accepted.

7.AI Features and Disclaimer

The Service uses AI technology (Anthropic Claude API) to support the creative ideation process. Please note:

  • AI-generated content may be inaccurate, incomplete, or unsuitable
  • The Service does not replace professional advice (legal, strategic, or otherwise)
  • The final decision on the use of AI suggestions always rests with you
  • We are not liable for damages arising from the use of AI-generated content

8.Limitation of Liability

8.1 Provider Liability

As the Service is provided free of charge, we are only liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded unless essential contractual obligations (cardinal obligations) are breached.

8.2 Third-Party Content

We are not liable for content submitted by users or for the availability and content of linked external websites.

8.3 Data Loss

We recommend regularly exporting important content. Liability for data loss not caused by gross negligence or intent is excluded.

9.Privacy

The processing of personal data is governed by our Privacy Policy, which forms part of these Terms of Service.

10.Term and Termination

10.1 Termination by Users

You may delete your account at any time without stating reasons. Following account deletion, your data will be deleted in accordance with our Privacy Policy.

10.2 Termination by the Provider

We reserve the right to suspend or delete user accounts in the event of serious violations of these Terms of Service without prior notice.

10.3 Discontinuation of the Service

As the Service is provided free of charge, we reserve the right to discontinue it at any time. We will endeavor to notify registered users at least 30 days in advance.

11.Changes to the Terms of Service

We reserve the right to amend these Terms of Service. Registered users will be notified of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12.Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the EU: Where mandatory consumer protection provisions of the country of residence provide more favorable terms, those provisions shall remain unaffected.

For disputes with commercial users, Cologne is agreed as the place of jurisdiction, to the extent permitted by law.

12.1 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13.Severability

Should any individual provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected.
